JUDGMENT
The facts of the complaint in brief is that the Opp.Party is public limited company who has invited public participation in investment and the complainant being being attracted to their offering invested to get a lump sum of Rs.80,000/- through their representative vide proposal No.067899 dt.16/12/1994 vide demand draft No.794872 of SBI, Nabarangpur which was accepted by the O.p and sent the original receipt with a promise that the maturity value of Rs.80,000/- will be paid to the complainant after due date of maturity is 19/12/2014 .The complainant on its maturity applied for refund of the matured amount but it was not accepted by the O.P and the application was returned undelivered, this clearly shows the malafide intention of the O.p. The complainant has also applied for the same to the Official liquidator at the Hon’ble High Court at Chandigarh and the letter was also returned back . Hence, prayed to do the needful and get the payments to the complainant and award monetary compensation for mental agony, financial loss and cost of litigation and such other relief as the forum deems fit and proper. Hence, this complaint.
Being noticed by this forum the opposite party remained silent and did not turn of to file any written version and in absence of any written version from the opposite party we proceeded the matter exparte and believed the allegations of the complainant and hence, we passed the order and dispose of the matter with the following directions.
ORDER
The opposite parties are directed to refund the deposited amount of Rs.80,000/- along with compensation of Rs.10,000/- for mental agony undergone by the complainant and cost of Rs.500/- to the complainant within one month from the date of receipt of this order, failing which the O.P is liable to pay interest @ 12% p.a. on the above awarded amount till the date of payment.
Pronounced in open forum today on this 16th day of September,2016under the seal and signature of this forum.
