                                                            JUDGMENT

1.                     The facts of the complaint  in brief is that,  the complainant has purchased  one   Micromax  Mobile from O.p. No.1 with a  consideration of Rs.4,000/- on 22.11.2014    and after its purchase  the  mobile set  started giving  trouble  like automatic switch off and touch screen problem and the matter was informed to the O.p. No.1  and   the Opp.No.1 sent the  mobile set  to Berhampur service centre  and demanded repair charges of aRs.800/-  and the complainant paid Rs.800/- to the Opp.Party No.1 for repairing charges and after few days   the same problems has arose and again the complainant sent  the mobile set  to the Opp.Party No.1  but the Opp.Party No.1 did not response .At last the complainant   finding no other option approached this forum for relief  and prayed  to direct the O.Ps  to replace the mobile set or   refund the  cost of the mobile  i.e. Rs.4,000/- with service charges of  Rs.800/-  and award  monetary compensation  of Rs.1500/-  and cost of litigation of Rs.00/-.Hence, this complaint.

2.                     On being noticed, neither the O.ps appeared nor filed any written version as such they were set exparte and  in absence of any written version from the opposite party we proceeded  the matter exparte and  believed  the allegations of the complainant  and  hence, we passed the order and  dispose of the matter with the following directions.

                                                              ORDER

                        The  opposite parties  are     directed to   replace  the handset of the same model with fresh warranty and return the  repairing charges of Rs.800/-   and pay  compensation of Rs.1000/-  for mental agony undergone by the complainant and cost of Rs.500/-  within one month from the date of receipt of this order, failing which the O.Ps are liable to pay  interest  @  12%  p.a. on the above awarded amount till  the date of payment.

                        Pronounced in open forum today on this 29^th  day of January,2016 under the seal and signature of this forum.

                         A copy of this order as per the statutory requirements , be forwarded to the parties    free of charge.
