Benijeer Bheekh        Vs.     CPP Group India.

 

Present:       None for the complainant.

               Complainant again failed to appear before this Commission on today, despite await him upto 2:00 PM. Similar was the position on the last date of hearing. The complainant failed to comply with the order dated 21.03.2023 regarding the production of insurance policy No. OG-20-9999-9960-00000079 on record and in the absence of this policy, no purpose will be served to proceed ahead to decide the complaint on merits, in the absence of necessary party i.e. M/s Bajaj Allianz General Insurance Company Ltd. Inder the circumstances, the complaint is dismissed for non compliance of order dated 21.03.2023, it being amounting to patent defect in the complaint. However, in the light of observation made in the order dated 21.03.2023, if complainant removes patent defect from the complaint and implead the appropriate parties, he shall be at liberty to file afresh complaint  before  this Commission, subject to period of limitation of time and in the fresh complaint, the  complainant will mention the particulars of this complaint and its fate. File be consigned to the record.
