ORDER

Heard the complainant.

 

2.  The complainant herein has taken a membership of the Country Club (India) Ltd., Hyderabad and company engaged in Hospitality Business operating Clubs, Hotels and Resorts and Marketing of Clubs and Vacation Members.

 

3.  Copy of the Membership Agreement dated: 06-09-2014 furnished, which discloses that the membership fee is non-refundable under any circumstances and that the membership fee is not a deposit.

 

4.  The Purchase Agreement for Club and Vacations Membership has been executed at Hubballi branch office of the Company as the first party and the complainant as the second party.  Therefore, branch office at Hubballi is the service provider.

 

5.  The complainant may also look into the condition No. 41 and 42 of the agreement executed by him.

 

6.  None of the opposite parties are carrying business within the jurisdiction of this District Forum.  No part of cause of action has arisen in Koppal territorial jurisdiction.  Hence, this complaint is not maintainable by the District Forum, Koppal.  Consequently the complaint is dismissed at the stage of admission. 

 

              7.  Issue free copy of the same to the complainant.
