Final Order / Judgement

Order No.  16                                           Date : 26.12.2017.  

          Today is fixed for hearing of petition filed by the o.ps. on 15.11.2017.

          No step is taken by any party.

          Perused the petition dated 15.11.2017 filed by the opposite parties and the copy of the order no. 10 dated 17.07.2017 passed by the Hon’ble State  Commission in connection with R.P. no. RP/59/2015.

          It appears from the order of Hon’ble State Commission that Hon’ble State Commission has been pleased to pass the following order :

          “That RP/59/2015 be and the same is allowed on contest. The impugned order is hereby set aside. Consequently, the complaint case stands dismissed for want of territorial jurisdiction.”

          This Revision Petition arose out of order dated 27.3.2015 passed by this Forum in connection with CC 53 of 2015.

          It appears from the order no. 10 dated 17.07.2017 passed by the Hon’ble State Commission in R.P. no. RP/59/2015 that Hon’ble State Commission has been pleased to set aside the impugned order and also passed order to dismiss this complaint for want of territorial jurisdiction.

          In view of the circumstances we have no alternative but to dismiss this CC case on the basis of order passed by the Hon’ble State Commission.

          Hence,

That the complaint be and the same is hereby dismissed on the basis of order no. 10 dated 17.07.2017 passed by Hon’ble State Commission in connection with  Revision Petition no. RP/59/2015
