This matter could have been dismissed for default, but we are of the view that the matter can be disposed of on perusal of the complaint petition and the submission of learned counsel for the OPs as it is a matter of 2003.
The history of the case is very peculiar because the matter was only traced out by searching of the record. It was last put up on 16.1.2004. Thereafter, the file was not put up, but it was put up on 18.11.2019. Today, this matter has come under the orders list.
Went through the complaint petition. The only allegation against the OPs in the complaint was that the complainant wants to clear up the loan dues and take back the documents from OP Nos. 1 and 2 but OP Nos. 1 and 2 did not respond to his request.
Learned counsel for the OPs submits that if direction is given by the Commission, the matter can be settled between the parties.
In view of the above, without going through the merit of the case, we direct the complainant to again approach OP Nos. 1 and 2 with necessary dues subject to calculation and OPs 1 and 2 would go by the request of the complaint and they will accept the dues as per Banking rules and return the documents to the complainant. The entire exercise be executed within a period of four weeks from today.
The complaint is, accordingly, disposed of.
