The case of the complainant is that,

Complaint is based on an agreement.  Complainant and opposite party entered in an agreement on 13/01/16 based on the cultivation of cardamom.  As per the complaint, the complainant alleges that opposite party withdrawn from the agreement and thereby he suffered a huge damage at a tune of Rs.3,17500/-.  Against this the complainant approached this Forum and filed this complaint for directing the opposite party to compensate the complaint.

Opposite party entered appearance and filed a preliminary objection regarding the maintainability of the complaint,  since there is  no consumer relationship in between the complainant and opposite party.
                                                                                                                         (Cont....2)

     Heard both sides,

The point that arose for consideration is whether  the complaint is maintainable or not.

By perusing the agreement and by going through the averments in the complaint, the Forum is of a considered view that the petition is against the non compliances of an agreement, and there is no valid consumer relationship between the complainant with the opposite party as discussed in sec 2 (d) of the Consumer  Protection Act, 1986, this is not a proper Forum for entertaining such complaint.  Hence complaint dismissed.
