Brief facts of the case:-

Case in hand is the allegation of  deficiency in service and unfair trade practice by the O.Ps  for  non payment of repair bill towards accident vehicle Car bearing Regd. No.OR-33H-7633against insurance policy No.HAX/S6570383which  the complainant sought  redressal.

The O.Ps not appeared though notices has been duly served resultant made exparte.

On perusal of the  record  it is revealed   that there is no dispute that  the complainant   was the owner of the vehicle  bearing Regd. No.OD-33H-7633  Car   was having the insurance coverage vide policy No. HAX/S6570383  commencing from 13.07.2018 to 12.07.2019(copies of the policy bond is in the file which is marked as Annexure-I)and the same was in force  on the   date of  accident  i.e. on Dt. 10.08.2018 at 6.00 A.M. while the above vehicle was coming from Jharsuguda to Sambalpur by that time one unknown  vehicle dashed from the back side  to the above vehicle as a result the said car dashed to tree as such the  car  was completely damaged.    Further there is no dispute  the matter of  accident claim  was duly  intimated to the   O.P. and to the  Badmal Police Station  bearing  Station diary No.06 DT.10.08.2018.  In turn the  surveyor has investigated   and given report  to the O.P. The O.P.  has  opened   accident claim   and  made correspondence to the complainant  to  submit the  required documents  for further processing of the accident claim.  After accident the complainant  took the above accident vehicle  to Infinity Hundai  situated near Sanjibani Hospital By-pass road, Jharsuguda service  centre.  The  complainant  paid an amount a sum of Rs. 74,710/- to the service centre  towards  repair and replace of the parts of the damaged  vehicle on Dt. 29.8.2019 vide invoice No. E720G2018005376(copies of the same is available in the file which is marked as Annexure-3).  But till date the O.P. has not paid the above  amount to the complainant.

We find there is gross deficiency  in service on the  part of O.Ps.   

To meet the  ends of justice    the following order is passed.

                In  resultant the complaint petition  stands  allowed  in  part against the O.Ps. 

The O.Ps are   ordered  to pay repair bill amount to the complainant as per the  repair bill  submitted by the complainant towards policy No. HAX/S6570383..  Parties  are left to bear their own cost.

The entire directions shall be carried out with in  45 days from the  date of receipt   of this order.   Parties are left to bear their own cost.

.Miscellaneous  order if any  delivered by this  commission  relating to this case  stands vacated. 

A copy of this order be provided to all the parties at  free of cost as mandated by the Consumer Protection Act,  2019 or they may download same from the confonet.nic.in to treat the same as if copy of order received from this Commission.

 

The judgment be uploaded forthwith on the website of the Commission for the perusal of the parties.

File be consigned to the record room along with a copy of this Judgment.
