                                                                                JUDGMENT

                The  present dispute arises out of the complaint petition filed by the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for non replacement of D BTE power one battery P -13 with a new one.

                The authorised agent   for the O.Ps  Sri  Jitendra Kumar Sahu, Sr. Audiologist,Cuttack appeared before the forum in person and  refuting the allegations of the complainant and made arguments touching the points both on facts as well as law.

                The complainant in person is present before the forum and has submitted   a memo to withdraw the case since he has already received   New  Get power D BTE power one battery P -13  from the  O.P.  with one year warranty  and he has no more claim against the O.Ps in connection with the aforesaid case. Further the complainant agreed in her memo to  return the old Guarantee card to the forum.

                We perused the memo and the memo is allowed.

                Accordingly the case is closed  as not pressed by the  complainant. Parties are left  to bear their own cost.
