Final Order / Judgement

After hearing the Ld. Advocate of the complainant and perusing the complaint and other documents we find that the complainant took a loan of Rs. 4,74,000/- , for which EMI was fixed at Rs. 12,036/-. It is the grievance of the complainant that although he made repayment of the loan amount in between 02.11.2019 and 04.04.2020 by installments at aforesaid rate of Rs. 12,036/-. Ops being money lender brought down the EMI from 12,036/- to 6,923/-. According to the complainant this was arbitrarily done by the financial institution for which the complainant had to make excess payment. But the letter addressed  to the OC written on 28.12.2020 by the complainant does not appear to be quite consistent with the contents of the complaint.

It is mentioned clearly therein that the loan scheme was converted on ‘fixed’ into ‘flexible’. That apart there in nothing in the record to show that the Bank refused to fulfill the grievance of the complainant by sending any letter or EMI. Even the complainant did not place his grievance before the Ops for disposal, straightway he has come before this Commission seeking relief.

Thus the case is pre-mature one and hence it is ordered that the case be and the same is dismissed without being admitted.

As the Consumer Complaint is dismissed accordingly the MA being no. 53/2021 filed by the complainant stands dismissed.

Let plain copy be given to the parties free of cost, as per CPR.
