            Pruned off unnecessaries case of the complainant Sri.Damodaran is that the opposite party No.1 is not retuning his Original RC book pertaining to his motor cycle KL 14G 8870 and duplicate key they retained while loan is granted to him eventhough HP termination letter and NOC is issued to him after closing the loan.

2.         In spite of receipt of notice issued by registered post, opposite party No.1 remained absent.  Hence opposite party No.1 had  to be set exparte.

3.         According to opposite party No.2 they are not retaining the RC and duplicate key pertaining to complainant’s vehicle.

4.         Issuance of Ext.A2 No objection letter and Ext.A3. HP termination notice itself proves that there is no amount due from the complainant to opposite party No.1.

5.         The retention of RC while granting loan itself constitute deficiency in service on the part of opposite parties.  The non-returning of RC and duplicate key shows that their deficiency in the services rendered to the complainant are at its  zenith.

            Therefore the complaint is allowed and opposite party No.1 is directed to return the RC  book pertaining to the Bajaj Discover Motor Cycle bearing Reg.No.KL-14 G 8870 and its duplicate key.  Opposite party No.1 is also directed to pay `5000/- as compensation and `2000/- as costs.  Time for compliance is limited to 30 days from the date of receipt of copy of order.  In default to return RC book, on application by the complainant direction will be issued to the concerned RTO to issue duplicate RC pertaining toKL-14 G 8870.  Opposite party No.2  exonerated from liabilities.
