Heard the ld. lawyer and perused the documents annexed with the complt.

We are of the view that the cause of action arose on 10/09/2007 as mentioned in para 08 of complaint and complainant has made correspondence in 2009 and subsequently made reference in 2013 for the purpose of creating cause of action. But law provides that such correspondence is of no use.

The instant case is not maintainable since barred by limitation.

Accordingly, the case is dismissed being barred by limitation.

The complainant is at liberty to agitate his case before the appropriate Forum on the selfsame cause of action.
