                                     ORDER NO- 03

 

This order is arising out of the MA being no-164/2019 filed by the Complainant in the consumer complaint no-490/2018 praying for some amendment in the cause title of the complaint as well as in the factual aspect of the petition of complaint.

 

In the application the Complainant has stated that at the time of service of notices upon the OPs the Complainant had detected that another name of the OP along with his address is required to be inserted in the cause title of the complaint in respect of the OP and the inserted OP will be the OP-1 and thereafter the existing names of the OPs will be mentioned accordingly. Apart from the cause title some factual aspects are also required to be inserted in the petition of complaint which were not mentioned at the time of filing the complaint due to inadvertence. If the said facts are not inserted/included the interest of the Complainant will be seriously prejudiced. Accordingly the Complainant has prayed for allowing this application.

 

As the notices were not issued and the OPs do not enter appearance, hence service of this application need not be required. We have carefully perused the content of the application filed by the Complainant praying for amendment in the cause title of the complaint as well as in the averment of the complaint by inserting the name and address of one OP and inserting some facts.

As the abovementioned requirement has been detected at the very outset i.e. before issuance of the notices upon the OPs, hence in our considered view the prayer of the Complainant should be allowed in the interest of Natural Justice.

 

Hence it is ordered that the MA being no-164/2019 is hereby allowed without any cost.

 

Fix 09.04.2019 for filing amended complaint by the Complainant showing incorporation of the schedule amendment by inserting the same as sought for.

 

            Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
