The complainant filed this case with the allegation that the complainant at the time of obtaining loan of Rs.4,00,000/- deposited four Kishan Vikash Patra of Rs.10,000/- each which matured on 29.11.2012. The complainant demanded those KVP after the payment of the loan amount. In spite of receiving letter the o.p.bank did not provide the documents to the complainant. The complainant filed some documents wherefrom it is evident that the bank took all measures for having the duplicate KVP certificates and post office received the said document. But it is curious enough that the complainant after the closing of  account and with the issuance of no due certificate failed to clarify as to whether the KVPs were obtained from the post office  and after adjustment of the matured amount of KVPs the amount due to the  bank was settled. The complainant failed to make the post office as a party to this case and the correspondence made between the parties  reveal that the matured amount of the KVPs was adjusted with due amount credited in the account of the complainant. Thereby we hold that the complainant has not come with clean hands and in order to harass the bank filed this case praying for enhancement of the cash credit limit whenever from the document it reveals that the account itself has been closed. Such being the position we hold that the case filed by the complainant is false and fictitious one and thereby the same is dismissed in limini.
