Brief facts of the case:-
Case in hand is the allegation of deficiency in service and unfair trade practice by the O.Ps for non refund of deposited amount towards non registration of house plot which the complainant sought redressal.
The complainant is found absent on repeated calls. O.Ps are also found absent. Perused the case record. The complainant has not complied the direction of this commission with regard to furnishing correct address of the O.P. On perusal it reveals that the complainant is found absent for several adjournments, even after service of notice. The case could not be proceed without due service of the O.P. owing to the incorrect address of the O.P. which duly reflected in form of postal endorsement. The complainant remained absent from the date of filing of the complaint, no steps have been taken on his behalf. Further the complainant could not appeared before this commission on the date fixed i.e. on 19.12.2022 though notices has been duly served upon him.
ORDER
In the result this commission dismiss the complaint for default U/S- 38(3)© of the C.P.Act,2019.
The complainant failed to perform his obligatory duty to remain present and adduce evidence.
In the result this commission dismiss the complaint for default U/S- 38(3)© of the C.P.Act,2019. Miscellaneous order if any delivered by this commission relating to this case stands vacated.
