THIRU. M. MONY, PRESIDENT

          This complaint has been filed by the complainant against the opposite parties under section 12 of the Consumer Protection Act 1986 seeking direction to replace the new Onida A/c machine and also to pay a sum of Rs.30,000/- towards compensation for deficiency of service and mental agony and Rs.5,000/- towards cost of the complaint.  

The averments of the complaint in brief are as follows:

The complainant state that he purchased Onida Split A/c 1.5 Ton Model No.S18 FLT-N3, 2 star on 19.6.2013.     The complainant paid a sum of Rs.26,490/- (i.e) a sum of Rs.25,490/- towards cost of the machine and a sum of Rs.1000/- towards installation charges.  From the date of installation itself the A/c. unit is not functioning properly.   The complainant gave complaints repeatedly; the opposite party came and filled the Gas  on 24.6.2013 and the problem was settled till January 2014.  Thereafter on 27.8.2014 the A/c. was not functioning.   Even after repeated request and demands the opposite party has not come forward to rectify the defects.   The complainant paid a sum of Rs.1800/- on 24.10.2014.  Even after that the opposite parties has not come forward to rectify the defects.   On 23.4.2015 the opposite parties’ technician came and took the out Door unit for testing.    The technician brought back the outdoor unit on 25.4.2015.   Even after repeated request and demands the opposite parties has not rectified the defects.  As such the act of the opposite parties  amounts to deficiency in service which caused mental agony and hardship to the complainant.

2.     Inspite of receipt of notice the opposite parties  did not appear before this forum and therefore the opposite parties were  set exparte.  

3.     Though the  opposite parties  remained exparte this  Forum should dispose this compliant fully on merits with available materials before this forum. 

4.     In such circumstances,  in order to prove the allegation made in the complaint the proof affidavit  filed by the complainant as her evidence, and also Ex.A1 to  Ex.A12  are marked.  

5.   The points for the consideration is: 

  1. Whether the complainant is entitled to replace the new Ondia A/c machine  as prayed for ?

 

  1. Whether the complainant is entitled to got a sum of Rs.20,000/- towards compensation and Rs.10,000/- towards mental agony with cost of Rs.5,000/- as prayed?

           

6.      POINTS 1 & 2:

          Heard the complainant counsel.  Perused the records.   The complainant purchased Onida Split A/c 1.5 Ton Model No.S18 FLT-N3, 2 star on 19.6.2013 as per Ex.A1.    The complainant paid a sum of Rs.26,490/- (i.e.) a sum of Rs.25,490/- towards cost of the machine and a sum of Rs.1000/- towards installation charges.  From the date of installation itself the A/c. unit is not functioning properly. The complainant gave  complaints repeatedly; the opposite party men came and filled the Gas  on 24.6.2013 and the problem was settled till January 2014.  Thereafter on 27.8.2014 the A/c. was not functioning.   Even after that repeated request and demands the opposite party has not come forward to rectify the defects.   The complainant paid a sum of Rs.1800/- on 24.10.2014 as per Ex.A4 for extension of warranty.  Even after that the opposite parties has not come forward to rectify the defects.   On 23.4.2015 the opposite parties’ technician came and took the out Door unit for testing.  The technician brought back the outdoor unit on 25.4.2015.   Even after repeated request and demands the opposite parties has not rectified the defects.  Hence the complainant  was constrained  to file this case for replacing the unit with compensation for deficiency in service and mental agony.   Considering the facts and circumstances of the case this forum is of the considered view that the  opposite parties 1 & 2 are jointly and severally liable to replace the new Onida A/c machine 1.5 Ton Split A/c 2 star and shall pay compensation of Rs.7,000/- (Rupees seven thousand only) towards mental agony with cost of Rs.5,000/- and points are answered accordingly.  

In the result the complaint is allowed in part.  The opposite parties 1 & 2 are jointly and severally liable to replace the new Onida A/c machine 1.5 Ton Split A/c 2 star and shall pay compensation of Rs.7,000/- (Rupees seven thousand only) towards mental agony with cost of Rs.5,000/-  (Rupees Five thousand only) to the complainant.  

The above  amounts shall be payable within six weeks from the date of receipt of the copy of this order, failing which, the said amount shall carry interest at the rate of 9% p.a to till the date of payment.

          Dictated by the President to the Assistant, taken down, transcribed and computerized by her, corrected by the President and pronounced by us in the open Forum on this the  9th   day  of  October  2017.
