But the complainant is absent without steps and from the record it is apparent that service of notice upon the complainant was effected on 01.08.2022. The case has come to this Commission on transfer from Barasat Commission on 22.04.2022 in view of the order passed by the Hon’ble State Commission. That means the complainant is aware about the advent of the case record at this Commission. In spite of that he is neglected to entered appearance before this Commission.

It seems to us that the complainant has lost interest in this case and for that it is next to impossible for this Commission to run the case with the recessive stands taken by the complainant. We think that this is a fit case where a dismissal order can be passed.

Hence it is ordered that the case be and the same is dismissed for non-prosecution; but without cost.

Let a plain copy be handed over to the parties free of cost as per CPR.
