The record is put up today for re-hearing. Neither the Complainant nor his Advocate remain present to take part in the hearing. The Advocate for the O.Ps is present and files hazira.

                                         On the previous date i.e. on 30.01.2023, the Advocate for the Complainant filed a memo to the effect that there is no instruction from the side of the Complainant to proceed with this case. On perusal of the case record, it is found that since 04.08.2020, the Complainant was absent and no step on his behalf was taken. From the above nature and conduct of the Complainant, it is clearly made out that the Complainant has no interest to proceed with this case further. In the above facts and circumstances of the case and considering the memo filed by the Advocate on behalf of the Complainant, this Commission is of the view that the complaint of the Complainant should be dismissed.

                                         Accordingly, the case of the Complainant is dismissed for default.
