1. The complainant has filed the present complaint against the OPs under section 35 of Consumer Protection Act, 2019. Arguments on the admissibility of the complaint on the point of territorial jurisdiction heard.  It is submitted by the counsel for complainant that complainant is residing at G-14, G-Block, Ghazipur, East Delhi. The OPs work for gain within the territorial jurisdiction of this Commission.  It is further submitted that cause of action also arose within the jurisdiction of this District Commission.  Hence, the present Commission has the jurisdiction to entertain this complaint.

2. We have perused the record, it is found that the complainant is residing in East Delhi. The address of the office of OP mentioned at point no.1 of array of parties does not fall within the jurisdiction of this Commission.  The address of the OP mentioned at point 2 in the array of parties does not attribute any cause of action. So far as the residence of complainant is concerned, it also does not fall within the territorial jurisdiction of this Commission.  Hence, neither the address of complainant nor the OP and even no cause of action has arosen within the territorial jurisdiction of this District Commission

3. In view of the above discussion, we are of the considered opinion that this District Commission does not have territorial jurisdiction to entertain and adjudicate the present complaint. The complaint is, therefore, directed to be returned to the complainant along with all annexures against receipt. 

Copy of the order be forwarded to the complainant free of cost. The orders be uploaded on www.confonet.nic.in. File be consigned to Record Room.
