MR LAXMI NARAYAN PADHI, PRESIDENT… The late husband of complainant was working as security guard under the OP w.e.f dt.01.04.2010 and expired on dt.04.06.12 while in service. She contends that, prior to drawn the salary amount from 01.06.12 to 31.03.13 of her late husband from APFC Rourkela, the OP not yet paying the amount to her. Hence she inflicting mental and financial crunches craves the leave of this forum to allow her claims along with Rs.80,000/- as compensation, cost etc.

2.         The OP has entered his appearance and filed version in the case through his A/A. Both parties has been minutely heard the case and perused the submissions.

3.         Without going to the unwarranted details we came to a conclusion that the instant matter has already filed by the same parties with same cause of action and this forum has already been decided the matter allowing the claims of complainant bearing C.C.No.81/2015 and an Execution Application bearing no.17/2016 also pending subjudice before this forum which relates to the CC.no.81/2015.

4.         Hence it reveals from the record that the complainant being ignoring, forgetting, however it may be, filed this complaint claiming the same demands, same parties with same cause of action is against the principles of resjudicata and as the earlier E.A. is in force, we dismiss the present case accordingly with an order as to no costs. Supply free copy to the parties concerned.
