MR LAXMI NARAYAN PADHI, PRESIDENT… The factual matrix of the complaint in brief is that, the complainant being a small farmer had sold 200 quintals of paddy to the OP.1 on dt.27.01.2014 and obtain receipt from the OP.2 vide serial no.236834. As per provisions of Govt. of Odisha, a farmer shall get Rs.10,000/- as bonus as Special Calamity Assistance by selling 100 quintals of paddy and the said benefits to be paid to the beneficiaries in the month of June/July 2014 but till date the complainant has not got the bonus in spite of selling 200 quintals of his paddy. Hence he approached the OP.s several times but for no response yet. So there is deficiency in service on the part of OP.s and he prayed before the forum to allow his claim along with cost and compensation in the ends of justice.

On the other hand the A/A for OP.2 appeared and filed his counter wherein he averred that, on verification from the office record, one farmer has sold 200 quintals paddy vide FIC Card No.3871 and also in the same name another farmer has sold 105.35 Kg vide FIC card No.3408. It is fact that the Government of Odisha FS & CW Department have fixed payment @ Rs.100/- per quintals for the paddy sold up to a maximum of Rs.10,000/- to a farmer but the department have not fixed any date line to pay the same to the farmers. Moreover the complainant never approached the OP.s orally or through letters. However after the requisition of concerned Tahasildar & MD Lamps, the department has released the bonus and the same could not be paid to the farmers due to non availability of correct bank account number, and a number of farmers in the same name and due to different FIC card numbers of farmers and some other technical errors, hence the delay of payment to the complainant is not intentional, the payment of present complainant will release very shortly within a week time, so there is no deficiency in service by the OP.s. Hence he prayed to dismiss the case in the interest of justice.
3. The counsel & a/a for both the parties have filed copy of evidences and considered. Both the parties have heard at length and perused the records.

The OP.no.2 has filed a reconciliation memo along with a copy of letter dt.25.4.15 wherein he reflected that, 'the payment towards SCA of Nandahandi Lamps has been reconciled and 35 Nos of farmers have been paid their SCA amount vide cheque No.378440, 378441 & 378442 dt.25.4.15 wherein the payment towards SCA of the complainant has been deposited with Secretary, KCC Bank, Jeypore for online payment of SCA into the Mini Bank account of Nandahandi Lamps. The MD Lamps, Nandahandi has been instructed to make payment of SCA to Sri Bissoyi, the complainant'.

Perusing the records and from the evidences filed by OP, it is crystal clear that the SCA payment of complainant has already been deposited with Secretary, KCC bank, Jeypore and the MD Lamps, Nandahandi i.e OP.no.1 is instructed by OP.2 to make payment the legitimate dues to the complainant as soon as possible. Hence from the above averments we are of the view that, the claim of complainant has already been settled by the OP with due process. The complainant is hereby instructed to approach the OP.s for the said payment and the OP.s are directed to make the payment to the complainant within 30 days of this order and the compliance report to be submitted before this forum for necessary perusal.
6. Failing the above order, the complainant has liberty to take shelter of this forum to execute the proceeding u/s 25 & 27 of the C.P.Act 1986.
No costs.
