CONSUMER COMPLAINT NO. 416  OF  2021

Sh.Nitin Thatai, Counsel for Opposite Parties(OPs).

ORDER

1.   Case file preponed and taken up today on the miscellaneous application No.12 of 2023 filed by complainant as the matter has been compromised between the parties.

2.   At this stage, vide his separate statement, Sh.Nitin Thatai, Counsel for OPs has stated that the parties have settled the dispute and as per settlement, OPs shall pay one time settlement amount of Rs.5,00,000/- to the complainant as full and final settlement within 15 days from today failing which the OPs shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a. from the date of filing of present consumer complaint. Vide his separate statement, Sh.Tarun Malhotra, Counsel for Complainant has admitted the aforesaid statement of counsel for OPs and prayed that the complaint be disposed of in terms of aforesaid settlement.

3.   In view of the statements of the counsels for the parties and in terms of the settlement, the complaint stands disposed of by passing the following order:-

     (i)  The OPs shall pay one time settlement amount of      Rs.5,00,000/- to the complainant as full and final settlement within 15 days from today i.e. 01.03.2023.

     (ii) In case OPs fails to pay the aforesaid amount   within the stipulated period, then OPs shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a.      from the date of filing of present consumer complaint     i.e. 28.06.2021 till its realization.

4.   The complaint is disposed of accordingly.

5.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
