ORDER

Order on admisibility The complainats being the transferres of a immovable property hae filed this complaint for a direction to OP.s to return the pledged title deeds and this complaint is filed after 4 1/2 years after death of transferee Smt.Vatsala. The office brought to our notice that Ex.Petition No.16/08 is pending in respect of same subject matter. The file reveals that Smt.Vatsala under whom the present complainants claim sought, had filed similar complaint against 2nd o.P. and the Forum by its order dated 06.06.2003 directed present 2nd O.P. to return the title deeds. In the executed proceedings the LR of Smt.Vatsala has also filed application to implead the present 1st O.P. as party and notice is issued to present 1st O.P. Though, there is an order of this Forum with regard to same subject matter, though present 2nd Complainant is the daughter of the deceased complainant, and same advocate has filed execution petition, again they have filed the present complaint for the relief which is already allowed by this Forum. Hence, the complaint is not maintainable and so the complaint is not admitted and hence rejected.
