CORAM: Surinder Kumar Sharma, President Anil Kumar Bamba, Member ORDER Surinder Kumar Sharma, President - The Complainant has filed the present complaint u/s 35 of the Consumer Protection Act, 2019. The Complainant No.1 is borrower and Complainant No.2 is a guarantor. Complainant No.1 has taken a loan of Rs. 15,00,000/- from Opposite Party on 20.05.14. As per the case of Complainants, it was agreed that the said loan was to be repaid in 180 instalments and the monthly instalment which was to be paid was Rs. 20,483/-. The case of the Complainants is that an amount of Rs. 22,50,000/- has already been paid to the Opposite Party and the Complainant No.2 requested several times for return of her title deeds of the property which she has given to the Opposite Party when she stood guarantor for Complainant No.1. It is the case of the Complainants that Opposite Party is demanding compound interest whereas the same should have been simple interest.
- We have heard the Counsel for the Complainant and have perused the file. The case of the Complainants is that the Complainant No.1 has obtained loan of Rs. 15,00,000/- from the Opposite Party. It is admitted case that Complainant No.1 has paid an amount of Rs. 22,50,000/- to the Opposite Party. It is also the case of the Complainant that the said loan was to be repaid in 180 instalments and the monthly instalment which was to be paid was @ Rs. 20,483/- per month. Therefore, the Complainant No.1 was supposed to pay the amount of Rs. 36,86,940/-. The Complainant has yet paid an amount of Rs. 22,50,000/- Therefore, under these circumstances, the prayer of the Complainants that the Opposite Party to be directed to settle the loan amount and to return the title documents of the Complainants is not maintainable at this stage. Hence, the complaint is dismissed.
