JUDGMENT.

                    All  the complainants have preferred this case jointly having same cause of action with the leave of the Forum.

2.                 The case of the complainants is ;that all the complainants have taken water pipe connection to their residential home in paying the rent regularly to the O.Ps. The complainants have alleged that although they are paying rent, there is no water supply to their residential houses and they have approached the O.Ps on several occasions for repairing of the water pipe for flow of water to their houses but the O.Ps did not listen to them. Hence the complaint.

3.                     Although the O.Ps have appeared, neither they chose to file written version nor they have proceeded with the hearing of the case. Accordingly on perusal of the materials available on record, the case is disposed of, since it is an urgent matter.

4.                      Heard the complainants. Perused the documentary evidence filed by the complainants. Perused the payment receipts issued by the O.Ps. It is seen that the complainants are paying water supply bill regularly issued by the O.Ps. It is further seen that the complainants have represented the O.Ps on dated 15.5.2017 and 18.5.2017, which show that there was no water supply provided to them by the O.Ps.  From these representation it is also; believed that there is no supply of water to the residential  houses of the complainants. Law is well settled that when the O.Ps are issuing water bills and receiving the bill amount from the complainants,  it is their bound-down duty to provide water flow to their water connections. The aforesaid negligent act of the O.Ps amounts to deficiency in service and the complainants have sufficiently harassed due to the same. Water is  very much  essential for a human being to alive  and due to non supply of the same, for the negligence of the O.Ps, needs sufficient compensation for the act. Hence ordered.

 

                                                           ORDER.

 

                        The O.Ps are directed to supply the water flow to the connections of the complainants sufficiently immediately after receipt of this order.  The O.Ps are further directed not to demand water bill from 18.5.2017 till date. Further the O.Ps are directed to pay Rs 40,000/- towards compensation and cost to the complainants. Since the O.Ps are government servant several chances are given to them to file their version in this case but they are not even care to file the same and are negligent in duty. Copy of this order be sent to the Secretary ,PHED, Govt. of Odisha, Bhubaneswar, for perusal on the administrative side.

 

                        Accordingly the case is disposed off.
