Final Order / Judgement

The case record is posted today for hearing of the case. Neither the complainant nor his Advocate is present nor taken any step. Advocate for the Ops is present and files hazira and also files a memo to drop the case. On repeated calls, none respond on behalf of the complainant. Hence, hearing of the case could not be taken up.

In the present case, the Ops were appeared and filed their written version. As it appears from the case record that the complainant remained absent since 18.11.2019 and did not turn up till today, for which hearing of the case impaired and the valuable time of this Commission is being wasted. On the other hand, Advocate for the Ops have filed a memo stating that the matter has already been resolved between both the parties and accordingly, the energy bill was revised and prayed to drop the case. Considering the memo submitted by the Ops and the nature and conduct of the complainant, this Commission is of the view that the complaint of the complainant should be dismissed.

Accordingly, the complaint of the complainant is dismissed for non-prosecution of the case. The interim order, if any, passed against the Ops is treated to be infructuous.
