The Advocate for the complainant is present and files hazira. The Advocate for the O.Ps is present and files billing statement from April 2018 to April 2023 against the Consumer No.321105210180 of Gokul Chandra Rana. Heard from both sides. Perused the case record.
It is stated by the complainant in her complaint petition that she had purchased a homestead land on Dtd.16.03.2022 having A0.02 dec out of A0.0450 of Mouza- Manikhamb, vide RSD No.10062202091 and 10062202099 from Madhusudan Rana and Smt. Bhagyashree Rana, Son and daughter of Sushanta Kumar Rana. After registration, the complainant mutated the said land in her name and paying rent to the Govt. Further, the complainant for obtaining a new electricity connection for domestic purpose through “Mo Bidyut” portal, sent an application on 23.11.2022 to the O.Ps and deposited Rs.4,640/- towards processing fee, security deposit and meter cost including GST charges etc. After depositing the above said amount by the complainant, the staff of O.Ps visited the house of the complainant and assured to supply the electric connection to her premises, but till date no electric connection was supplied to her house. For the above acts of the O.Ps, the complainant has suffered mental agony and financial loss arising out of deficiency in service on the part of the O.Ps, for which she has filed this case praying for supply of electric connection along with compensation and litigation expenses.
On the other hand, the O.Ps have stated in their written version, inter alia, that the case is not maintainable. Admitting the fact that the complainant has applied for new service connection and also made online deposit on 30.11.2022. After receipt of her application, necessary spot verification was conducted in presence of the complainant and it was detected that one service connection bearing Consumer No.321105210180 is existing in the name of Gokul Chandra Rana over Plot No.253 having A0.85 dec, Khata No. 335, Mouza- Manikhamb and an arrear outstanding of Rs.1,47,497.73 was accrued against his Account. Further, the complainant has purchased a part of the land i.e. A0.02 dec from Gokul Chandra Rana from Plot No.253. Hence, the complainant was intimated through mobile message that power supply cannot be allowed until the aforesaid arrear is cleared. So, the case is liable to be dismissed with cost.
Perused the complaint petition, written version as well as the documents filed by both the parties. It is argued by the Advocate for O.Ps that the complainant may be directed either to submit N.O.C before the O.Ps for supply of electric connection by settling all outstanding arrear stands against Gokul Chandra Rana over Plot No.253 or pay the outstanding arrear as may be proportionated on pro-rata basis over Plot No.253 as per provision under Rule-17 (iii) (iv) of O.E.R.C Distribution (Conditions of Supply) Code-2019. The Advocate for complainant is agreed with the second option of the O.Ps. In this regard, the Advocate for O.Ps submitted that as per above provision & their calculation, the complainant is required to pay Rs.29,666.58 i.e. Rs.29,667/- for supply of electric connection to her premises.
Therefore, this Commission is hereby directed the complainant to deposit Rs.15,000/- upon receipt of this order and the O.Ps are directed to supply electric connection to the premises of the complainant within 5 days of receiving of Rs.15,000/- from the complainant. Further, the O.Ps are directed to issue regular electric bills as per her actual meter reading and the complainant is directed to pay regular electric bills along with the proportionate rest amount of Rs.14,667/- in 10 equal monthly instalments. No order as to cost. The interim petition dtd.07.08.2023 filed by the complainant is disposed of accordingly.
