           The complainant being a retired doctor with the facility of enjoyment of West Bengal Health Scheme, 2008. The wife of the complainant got treatment with the o.p.no.4 and the stent was implanted for which the complainant had to bear and expenses of Rs. 2,86,049/- and prayed for reimbursement of the medical bill. The complainant applied for reimbursement but the reimbursement was not allowed for which the complainant filed this case.

          On perusal of the record we find that the treatment was rendered to the said patient between the period from 12.12.2013 and 14.12.2013. The complainant prayed for reimbursement of the bill on 06.01.2014 since a dispute arose and the matter was referred to Department of Health and Family Welfare, Government of West Bengal. Assistant Secretary, Government of West Bengal sent a letter to the Superintendent, Apollo Gleneagles Hospitals on 24.07.2015 whether the permission was sought for from the West Bengal Health Service authority for the use of more than  one drug eluting stents during the period of treatment of the wife of the complainant. No reply has been filed by the complainant in support of the said contention that the permission was provided by the department concerned and accordingly the medical reimbursement bill was not allowed.

          In view of the said fact we do not find any deficiency in service on the part of the o.ps. Therefore the claim made by the complainant cannot be entertained and accordingly the same is dismissed in limini.
