            The complainant is present. Today is fixed for ex parte hearing.

            Hd. and considered the case.

            This is the case of the complainant is short is that he purchased a Nokia Mobile set being its No.352853050561204 along  with its battery No.0670400524152T131B16502331 and subsequently the Mobile was held defective in its use. Eventually, the complainant moved before the Op. no.1 Nokia Care Centre. But Op. no.1 failed to give effect of its necessary repairing one, nor any appropriate step taken by him. Ultimately, the complainant moved before this Forum with a prayer for replacing with a new Mobile set or refund of the cost price.

             The Ops. have taken no steps despite having receipt of the summons vide A/Ds lying with the record.

             Upon careful consideration of the matter as a whole, it appears that the claim of the complainant is genuine and as such his prayer should be granted.

             Hence ordered that the complainant’s case and  the same is allowed ex parte.

             The Op No.2, the Manager Gift House is hereby directed to replace a new Mobile sets along with its battery worth equivalent to Rs.3,900/- ('Three thousand nine hundred) only of or refund the price paid by the complainant at the time of purchasing Nokia Mobile Set being Its No.352853050561204 against cash memo dated 25/08/2012 within one month with  immediate effect, in default, the Ops. will be liable for being prosecuted at the instance of complainant.

            Copy of the order along with extra copy made for service upon the Ops. free of cost.
