Perusal of the record shows that as per office report, a cheque bearing No. 967698 dated 13.2.2018 for Rs.31,100/- of State Bank of India, in favour of District Consumer Disputes Redressal Forum, Moga has been received from Hon’ble State Commission, Punjab, Chandigarh and said cheque has been deposited in the relevant account on 3.4.2018.
Thereafter, notice to both the parties issued, but none has appeared on behalf of Ms.Sadhna Sharma, but however, earlier Sh.Vishal Jain, Advocate appeared on behalf of ICICI Lombard and prays for adjurnment to file the application for claiming the impugned amount which is lying deposited in this Commission.
Since last about 1½ years i.e. from April, 2018 said amount is lying deposited in the relevant account of this Commission, but despite repeated adjournments, the JD/ respondents ICICI Lombard has not filed any application in this regard for releasing the impugned amount.
Now perusal of the record of last 13 hearing shows that none has appeared on behalf of JD/ respondents ICICI Lombard, hence it is presumed that no body is interested in claiming its right of the impugned amunt. So, in the interest of justice, the office is directed to keep the impugned amount in the shape of FDR till further order and thereafter, the file be consigned to record room.
