F I N A L O R D E R
1.The complainant Bapi Banik has filed this complaint seeking compensation alleging deficiency in service on the part of the O.P. Bank.
2.The pleading of the complainant is that being approached the O.P. Bank sanctioned a loan of Rs.10,38,676/- vide sanction letter dated 19.12.2020.
3.The complainant could not close his loan account due to Covid Pandemic Period and requested the O.P. to renew the said loan for a further period of one year. Finally the loan account was closed by charging an additional amount of Rs.27,877/- which is illegal. And accordingly the loan closure certificate was issued on 26.08.2021 in favour of the complainant.
4.The O.P. Bank submitted written objection and in paragraph 14 (b) (c) the O.P. Bank substantiated the case that the complainant availed that loan by pledging golden ornaments. And closure date of the loan account was 19th June, 2021 for a closure amount of Rs.11,01166.46/- but the complainant could not close the account on such date rather close the account on 18th August, 2021 for which he had to pay Rs.11,29,043.46/- by payment of an addition interest of Rs.27,877/-. As such there is no deficiency in service.
5.Both the sides submitted evidence on affidavit and relevant documents.
6.Hearing argument we frame the following point for discussion and decision-
(I) Whether charging of additional amount of Rs.27877/- amount to deficiency in service?
DECISION AND REASONS:-
7.As we have discussed above the case of the complainant and reply of the O.P. we find the admitted position that the complainant availed a loan for 6 months which was supposed to be closed in the month of June, 2021 for which the complainant was supposed to pay Rs.11,01,166.46/- with interest.
8.Further admitted position is that the complainant closed the loan account on 18th August 2021 i.e., after 2 months of the stipulated period and for that the complainant had to pay an additional amount of interest for Rs.27,877/-.
9.There is no case of the complainant that the O.P. Bank charged additional interest beyond the agreed terms and conditions. Hence, we find no deficiency in service on the part of the O.P. Bank.
10.The point is decided accordingly against the complainant.
11.In the result, the case of the complainant stands dismissed, however, without cost.
12.Supply a copy of this Final Order free of cost to the parties.
