This Commission vide its order dated 13.12.2005 directed the appellant/applicant to deposit sum of Rs.1 Lac with the State Commission as a precondition of the stay. The appeal was finally disposed of on 16.12.2009. While remanding the case back to the S/C for a afresh decision it was observed as under:- “At the time of admission of the two appeals filed before us, we had directed both the appellants/OPs to deposit Rs.1 lakh each. It appears that the Hindustan Petroleum Corporation Limited has paid Rs.20,000/- each to the five complainants, and Krishna Gas Agency has deposited Rs.1 lakh with the State Commission.” The State Commission vide its order dated 21.04.2011 allowed the complaint and awarded a compensation of Rs.5 Lac alongwith costs of Rs.5,000/-. It is stated in the application that the insurance company has paid the said sum of Rs.5,05,000/- to the Complainants/respondents no.2-6. Since the amount awarded by the State Commission has been paid to the respondents by the insurance company, appellant/applicant has moved this application seeking release of Rs.1 Lac deposited by it before the State Commission. Since the amount awarded by the State Commission vide order dated 21.04.2011 after remand of the complaint has already been paid to the complainants/respondents, the State Commission is directed to release the amount to the applicant/along with accrued interest thereon. Misc. application stands disposed of. |
