We have heard the Ld. Counsel on behalf of the complainant and also perused the case record. From perusal of the case record, we find here that this execution case has been filed by the Decree Holder/ complainant against the opposite party for the compliance of the order passed in consumer case No.18/2018 dated 02.09.2023. The Ld.Counsel has submitted that the opposite party /Judgment debtor has agreed to comply the order passed in consumer case No.18/2018 and intimation slip from the Department of Post Office, Gumla Branch has also been sent, requesting to the complainant to collect the EMO amount from Head Office, Gumla.
The Ld. Counsel in the light of further development took place has submitted that the complainant did not want to proceed with the case and it has prayed permit to withdraw this execution case on the basis of that development and also on the settlement basis.
We have heard the Ld.Counsel on behalf of the Decree Holder/ complainant and perused the record. From perusal of the record we find that in the light of this order of Consumer Case No. 18/2018 dated 02.09.2023 an intimation slip from Gumla Head Post Office has been received, which is kept in the record, in which it has mentioned that the complainant is requested to come to Head Post Office Gumla to collect EMO amount and to provide account details for payment process. The Ld.Counsel in the light of recent development and also on the basis of settlement, it has prayed to withdraw this Execution Case. It is also prayed to recall the date of this case.
After hearing we find that as the matter has been settled out side of this District Commission, therefore, this petition filed on behalf of the Decree Holder/ complainant i.e. Sushil Kumar Gupta to withdraw this execution case which has been filed against the opposite party i.e. Judgment/ debtor is hereby allowed and this execution case is hereby disposed of on the basis of settlement, which has been taken place outside of this District Commission.
