JUDGEMENT.
The crux of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non payment of balance amount which is available in the pass book bearing No.0927973715 (old account No.507257) for which the complainant (Legal heir) sought for redressal of the grievances raised by the complainant.
On being noticed the O.Ps appeared and filed written version.
Heard arguments from the O.Ps and from the complainant. Perused the record, documents, written version filed by the parties.
This District Commission examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties touching the points both on the facts as well as on law.
FINDINGS.
Undisputedly the S.B. account No. .0927973715 (old account No.507257) standing in the name of Late Smt. Krishna Dasi Mohanty with balance of Rs.4,496.50 as on 31.3.2021(Pass book first page is available in the file which is marked as Annexure-I). Undisputedly Late Smt. Krishna Dasi Mohanty had expired on Dt. 12.02.2017. (In support the death certificate is available which is marked as Annexure-2).. Undisputedly the complainant has filed legal heir certificate (copies of the same is available in the file which is marked as Annexure-3). Undisputedly all the legal heirs had executed affidavit and indemnity bond in the format prescribed by the Postal Department where relinquish their claim and given chance to Ms. Rupanjali Mohanty to receive the above amount(copies of the affidavit and indeminity bond are available in the file which are marked as Annexure-4)
In the written version the O.Ps submitted that after receipt of the claim application along with other necessary documents from the complainant the Postmaster, Rayagada H.O. will be settled the claim as early as possible.
To meet the ends of justice the following order is passed.
ORDER
For the best interest of justice this District commission came to conclusion that the complainant should submit all the necessary documents before the Head Postmaster, Rayagada with in 7 days from the date of receipt of this order and the H.P.M., Rayagada should disburse the pass book amount account bearing S.B. account No. .0927973715 (old account No.507257) to the complainant with accrued interest with in 15 days from the date of receipt of documents from the complainant.
Accodingly the case is closed. Parties are left to bear their own cost.
Copies of the order be served on the parties free of cost as per rule.
