Complainant and accused are present.  It is seen this Forum in CC No. 106/2011 had passed the following order:

Complaint is allowed.  OP3 is directed to deduct Rs.1400/- per month out of the monthly salary payable to OP1 and to credit the same to complainant-society till the closure of loan.  The parties shall bear their own costs.

            OP3 in the said CC No. 106/2011 is the Block Educational Officer, Office of BEO, Robertsonpet, KGF, but in this case accused is OP2 in the said CC No. 106/2011 against whom no order has been passed.  Hence, taking cognizance by this Forum itself is wrong.  Hence the Order is recalled.

            Complainant is at liberty to take appropriate action against the appropriate person if need be.  Hence, u/s. 200 CrPC r/w Sec. 27 of C.P. Act, further proceedings are dropped.
