Ld. Advocate for the complainant is present .heard Ld.Advocate for the complainant on admissibility of the consumer complaint.
On perusal of the petition it is observed that the complainant applied for loan and the same was sanctioned of Rs 26,50,000/ (Rupees Twenty six Lakh fifty thousand) only from the OPs ( The HDB Financial Services Ltd..) vide a loan agreement No.3560775 dated 24/01/2018 to be paid through EMIs of Rs,74,000/ for the purpose of purchasing a vehicle. ( Details of the vehicle:- Goods Carrier,Tata Motors Limited,registration no.WB65C5249 dated 26/02/2018).The complainant was regularly paid the EMIs but some of the EMIs missed due to financial constraint for Covid-19 Lock down and also government’s instruction not to run any vehicle on Farraka Bridge in 2019.The OPs pressurized the complainant on several occasions for payment of the due amount but the financial condition of the complaint was in favour to pay such a big amount at a time.The OPs tried to seize the vehicle forcibly by showing some fake order and documents but failed to do so.However,the complinant was in great mental agony and pain.
It appears from the photocopy of the documents annexed with the complainant petition that Authorization Certificate Of NP (goods) was issued by the Transport Department,Government of West Bengal,Certificate of Registration,National Permit Certificate, Certificate of Insurance cum Policy schedule HDFC ERGO etc but there are certain documents which are necessary to establish the complaint application. The loan agreement book, Bank statements of payment of EMIs,letter of proposal for final settlement and the documents related to cause of action after 24/01/2018.
In view of the above observation and lack of above mentioned documents we are not inclined to admit the consumer complaint in its present form and accordingly the same is rejected.
The CDF-II CC being No.1752023 is thus disposed of.
