The case of the complainant is, in brief that he along with his friend had visited the restaurant of the Op on 11.3.19 and placed order for a vegetarian lasagana and a burger. After a long time the baby brought and served the food at their table . But on taking a bite from the burger, the complainant had to spite the crumbs as it contained chicken. The complainant, being a devotee to the Lord” Panch Mukhi Balaji, is a pure vegetarian and as he was made to eat non-vegetarian, his religious sentiment got severely hurt.
The complainant asked for an explanation, but the Op’s men were tight-lipped. A vegetable sandwich was placed in front of the complainant, who, however , did not take it. He asked for bill and the bill hence raised contained charges for three items, i.e., lasagana, non-veg-burger and veg-sandwich and was not in proper paper specially with GSTIN/GST registration. The complainant protested and the said bill was replaced by a second bill. The complainant claimed a bill in proper paper like Tax invoice and the Op brought a third bill that too duplicate one amounting to Rs. 200/- only without paying any heed to his demand for a lawful bill.
The complainant alleges that by serving a non-veg food instead of the veg one, the Op caused deficiency in service and by giving duplicate bill, particularly, without GSTIN and not in tax-invoice, the Op committed unfair trade practice. Hence is the case.
A perusal of the fact transpires that while the complaint centres round the supply of non-veg food in place of ordered veg one, the copy of the bill(annx.1) dated 11.3.19 enclosed as supporting document is for veg. lasagana worth Rs.200/- . Therefore, the document does not support the allegation documentarily.
The complainant states that the first bill included three items, i.e., lasagana, Burger(non-veg) and veg. sandwich, which was, however, replaced on question from the complainant, by the second bill. It is quite obvious that the first bill so raised could have, rather, proved the service of non-veg Burger on the table.
It is further alleged that the complainant was made to eat non-veg food and thereby the Op’s act went against his religious values. The complainant has to undertake “Char Dham Yatra” to wash out his sin and purify his soul,for which rs.2,00,000/- has been claimed as one of the relieves. It goes without saying that such a matter is not adjudicable in the forum.
The OP’s committing alleged unfair trade practice by raising bill not in proper paper like tax invoice or not with imprinted GSTIN/GST registration No. is matter concerning the appropriate Department of the Govt. and nohow comes up in the relation between the consumer and the service provider.
Perused as above and considered. The case thus does not have the admissibility so far as the Forum’s jurisdiction is concerned and hence not admitted.
