3.       The Medical Surgeon posted at Govt. Community Health Center, Railway Road, Kalka; Distt. Panchkula.

4.       The Gynecologist posted at Govt. Community health Center, Railway Road, Kalka, District Panchkula.

Mr.Rajiv Narwal, Medical Officer appeared against the notice u/s 27 of the CPA and also filed reply to the execution application alongwith a copy of judgement dated 13.02.2012 passed by the Hon’bel State Commission in appeal No.1212 of 2008 titled as Govt. of Haryana vs. Bimlesh in which appeal has been accepted and the complaint of the complainant has been dismissed. In view of the order of the Hon’ble State Commission, the present execution application has become infractuous. At this stage, counsel for the complainant has also made a separate statement in which he states that he withdraws his execution application.

Heard. In view of the statement made by counsel for the complainant, the present execution application is hereby dismissed as withdrawn. We order accordingly.

                   A copy of this order be sent to the parties free of costs and file be consigned to record room after due compliance.
