Hazira is filed on behalf of the complainant.

Heard ld. Advocate for the complainant with regard to admission hearing of this case.

The complainant has filed this case praying for an order for getting back the documents submitted before the OP Bank for sanctioning loan by the bank, as also for compensation of Rs. 1 lakh on the principle ground that loan of Rs. 17,63,860 was sanctioned, but the said loan was not disbursed in favour of the complainant rather, the original documents of the complainant lying in the custody of the OP have not been returned.

Perused the complaint and the Xerox copies of documents filed by the complainant on record.  It is to be noted that no document is produced on behalf of the complainant to show as to alleged sanction of any loan in favour of the complainant.  The complainant also has not filed any such paper or document to show that the documents in question are lying in the custody of the OP bank.

It further appears from the annexure P-14 [copy of judgment dt. 08-07-2011 of the Hon’ble High Court in relation to W.P. No. 10919 (W) of 2011] that the said writ petition, filed against the said bank by this complainant with similar nature of prayer, was dismissed by the Hon’ble Court.

Under the circumstances we feel that the instant complaint is liable to be dismissed since the same is not maintainable.

Hence, it is

Ordered

          that the instant complaint case be and the same is dismissed being not maintainable.
