The appellant is the complainant in CC.138/04 in the file of CDRF, Kasaragod.  The Forum has directed the opposite party/BSNL authorities to refer the matter to an arbitrator within 3 months failing which the opposite parties are to pay a sum of Rs.5000/- as compensation to the complainant.  The Forum has placed reliance on the decision in General Manager Vs. M.Krishnan and Another, III 2009 CPJ 71 (SC).

2. We find that the dispute is with respect to the alleged excess amount claimed in the telephone bill.  Hence we find that the decision cited above is squarely applicable.  We find that there is no scope for admitting the appeal.

In the result the appeal is dismissed in-limine.

The office will forward copy of this order to the Forum.
