ORDER

By Smt. Padmini Sudheesh, President The case of the petitioner is that, petitioner had availed a loan for Rs.2,50,000/- from the respondents for purchasing a Lorry and received the amount from respondent 1 on 19/12/2000. At that time respondent 1 has issued a lease instalment payment schedule. As per the schedule petitioner has to pay Rs.3,86,500/- by 36 monthly instalments. Petitioner had paid the said amount within 24/12/2003 to the 2nd respondent. But the respondents are not ready to close the H.P. and to return the documents of original R/C, Insurance particulars and blank signed papers. Later Lawyer notice sent. No reply and no remedy. Hence this complaint. 2. The respondents are set exparte. 3. To prove the case petitioner filed affidavit and 28 receipts which are marked as Ext P1 series. 4. According to the petitioner he is entitled to get all the documents stated in the complaint. 5. There is no evidence to the contrary. 6. In the result complaint is allowed, and the respondents are directed to return the R/C book, Insurance particulars and blank signed papers to the complainant within one month. Respondents are further directed to pay cost of Rs.2,000/- (Rupees Two thousand only). Comply the order within one month. Dictated to the Confdl. Asst., transcribed by her, corrected by me and pronounced in the open forum this the 31st day of July 2008.
