Son and Authorized Representative of the complainant is present in person. Mr. M. Wadhwani, Advocate representing the opposite party-Thai Airways International under instructions states that the opposite party Airlines is willing to pay a sum of Rs. 3,50,000/- ex-gratia in full and final settlement to the complainant, if the complainant is willing to withdraw the allegations of deficiency in service made in the complaint. The offer -2- is acceptable to the complainant. Let the statement of the learned counsel for the respondent and that of the A.R. of the complainant be recorded. Statement of Mr. M. Wadhwani, Advocate and Mr. Rajendra Gupta, authorized representative for and on behalf of Mrs. Premvati, complainant have been separately recorded. In view of the settlement reached between the parties, the present complaint is disposed of. The allegations of deficiency in service made therein are treated as withdrawn. The opposite party – Thai Airways International is called upon to pay a sum of Rs. 3,50,000/- (Rupees three lac and fifty thousand) to the complainant by means of Bank Pay Order / Cheque within a period of six weeks from today. In view of the above, we leave the parties to bear their own cost. |
