Mr. R. Goswami, learned counsel, appearing for the opposite party Nos. 1 and 2 is present. None appeared for the complainant.
This Commission on 12-3-2018 passed the following order:-
Mr. I. Baruah, learned counsel, appearing for the opposite party Nos. 1 and 2 is present.
On perusal of the order sheets, it would reveal that this Commission passed an order on 17-4-2017 for taking steps upon opposite party No. 4 by dasti service fixing the next date on 30-5-17. On 30-5-17, learned counsel appearing for the complainant had prayed for further three weeks time to take steps upon opposite party No. 4.
The prayer so made was also allowed. Thereafter, the matter was listed on 13-7-17, 29-8-17, 9-11-17 and 8-11-18. But none appeared for the complainant on those dates. This Commission therefore fixed today for passing necessary order.
Today when the matter was called on, Ms. S. Begum, learned counsel, appearing for the complainant prayed for four weeks time to take steps upon the opposite party No. 4 by dasti service.
As the case is filed under the Consumer Protection Act, 1986, this Commission reluctantly grant further four weeks time to the complainant for taking necessary steps as per order dated 17-4-2017, making it clear that failing to do so, the complaint case would stand automatically dismissed.
List it on 9-4-2018.
Thereafter also for the ends of justice, the matter was directed to be listed on 9-4-2018, 25-5-2018 and 17-7-18 for appearance of the complainant.
But today also when the matter was called on, none appeared on behalf of the complainant.
In view of the same the complaint case is dismissed for non-prosecution.
