This is a complaint filed by the complainant under Section 12(3) of the Consumer Protection Act, 1986 praying to direct the opposite parties to pay to the complainant a sum of Rs.1,00,000/- for defective TV sold to the complainant and to pay Rs.20,000/- as compensation towards the negligence, carelessness and inordinate delay, insufficiency in service and to pay Rs.25,000/- for unfair trade practice, mental agony, pain and sufferings and stress along with Rs.3,000/- being the cost of this legal notice totaling to Rs.1,48,000/- and to replace the defective TV with a new one and to pay a sum of Rs.10,000/- for costs of the complaint and other reliefs.
2. Disputing the complaint, the first opposite party filed the reply version. Opposite parties 2 and 3 were called absent set exparte. The complainant was examined as CW1 and Ex.C1 to Ex.C8 were marked.
3. Today this complaint was called. Complainant present. Counsel present. Opposite party absent. Counsel present. Complainant filed memo of compromise and memo of withdrawing the complaint. In view of the memo, this complaint is hereby dismissed. No cost. The memo of compromise and the memo for withdrawing the complaint shall form part and parcel of this order.
