Order

22.07.2021- A time petition is filed by the engaged Counsel of the Complainant but it is not moved.
Hence time petition is rejected.
A written argument is submitted from the side of the O.P. and they also relied upon the judgment passed in connection with C.C.-72 of 2019 dated 30/12/2020 by this Commission and also the judgment passed by the Tripura State Consumer Disputes Redressal Commission, Agartala in case No.A/2/2021.
Today was fixed for hearing on the issue of maintainability of the proceeding.
Accordingly, we are passing order.
It is pertinent to mention here that earlier this Commission delivered a judgment in connection with C.C.-72 of 2019( Smt. Parmita Deb Vs. The Sector Head, Agartala City Office Sahara Credit Co-operative Society Ltd.) on 30/12/2020 and that case was dismissed being not maintainable as per law. Thereafter, the Complainant Smt. Paramita Deb preferred an appeal before the Hon'ble State Consumer Disputes Redressal Commission, Agartala and the appeal was numbered as case No.A/02/2021. The Hon'ble State Consumer Disputes Redressal Commission, Agartala upheld the order passed by this Commission vide order dated 10/05/2021. So the instant case is a covered case. It is not necessary to discuss in details about the facts of the case as Opposite Party is the same.
Relying upon the judgment passed by the Hon'ble State Consumer Disputes Redressal Commission, Agartala (Supra), we are in the opinion that the instant complaint is also not maintainable in law.
Hence, the complaint is dismissed and no cost.
Supply copy of order both sides free of costs.
