J U D G M E N T [ORAL]

 

Heard Mr. Biswanath Majumdar, Ld. Counsel appearing on behalf of the appellant-petitioner, Sri Subhasish Datta. Also heard Mr. Pradip Chakraborty, Ld. Counsel appearing for the respondent no.2, Air India Ltd.

2. This appeal has been preferred against the judgment and order dated 01.11.2021 passed by the learned District Consumer Disputes Redressal Commission, West Tripura, Agartala in connection with Case No.CC.15 of 2019.
3. The main grievance of the appellant-complainant (here-in-after referred to as the complainant) as surfaced from the submission of Mr. B. Majumder, learned counsel appearing for the complainant is that the complainant was carrying a pet while he was coming from Kolkata to Agartala by Air India Flight. The Air India people as per their rules had demanded medical certificate as well as the necessary fare for carrying such pet. The complainant had arranged the medical certificate. Since there was no ATM counter and network was not functioning within the lounge area, he could not pay the necessary fees. However, he collected necessary money from other sources outside the Airport. Thereafter, he deposited the money and came to Agartala along with the pet.
4. The plea of the complainant is that since internet was not in operation at that time in the Airport, the Air India Ltd. was negligent in providing appropriate service to the complainant. According to Mr. Majumder, learned counsel, the Air India Ltd. had to arrange proper networking system in the Airport and there should be an ATM counter in the Airport.
5. We are afraid to accept such proposition of learned counsel appearing for the complainant. It is the responsibility of the Airport Authority of India to make the system in appropriate condition and to provide required space to install ATM counter of the authorised bank or other financial authorities. It is not for the Air India Ltd. to provide all those facilities to the customers or travellers.
6. Having viewed the above perspective, we do not find any deficiency of service on the part of the Air India Ltd. Hence, the appeal being devoid of merit stands dismissed.       

The judgment and order dated 01.11.2021 passed in connection with Case No.CC/15 of 2019 by the learned District Commission stands affirmed.
