Final Order / Judgement

Today is fixed for passing necessary order. The Ld. Advocate of the complainant is present. The Ld. Advocate of the OPs is also present. From the order passed on 24.03.2022 it is found that the complainant has taken up the dispute with NCLT (National Company Law Tribunal) for which he is no longer interested to proceed with the instant case. No objection is raised from the other side. The complainant should not be allowed to proceed with the same litigation before two forums. As such, the prayer of the complainant for dismissal of the case is allowed.

Hence it is ordered that the case be and the same is dismissed for non prosecution.
