This complaint has been filed before DCDRC, Chennai (North) as CC.No.41/2019 and transferred to this commission by the order of the Hon’ble State Consumer Disputes Redressal Commission, Chennai and taken on file as CC.No.60/2022.
The complaint was filed by the complainant under section 12 of the Consumer Protection Act 1986 alleging deficiency in service against the opposite parties in auctioning the pledged gold stud without any intimation to him along with a prayer to direct the opposite parties to return the pledged gold stud (2 numbers) with 12% interest from the date of pledged gold stud till the date of payment and to pay a sum of Rs.4,00,000/- towards compensation for the mental agony and hardship caused to the complainant and to pay a sum of Rs.4,00,000/- for deficiency in service and unfair trade practice on the part of the opposite parties.
No representation for complainant inspite of service of notice and informed through Commission. Written Arguments not filed. Sufficient opportunities given to the complainant for filing written arguments and for appearance on 15.07.2022, 05.08.2022, 24.08.2022, 15.09.2022, 27.09.2022, 18.10.2022, 07.11.2022, 21.11.2022, 06.12.2022, 20.12.2022, 02.01.2023, 23.01.2023 and on 31.01.2023. In spite of the same, complainant failed to appear and prosecute the case. Hence, this commission is of the view that no purpose in keeping the complaint on file. Hence the consumer complaint is dismissed for non prosecution. No cost.
