ORDER

 

By consent of the learned counsel for the parties, the State Commission is directed to immediately permit withdrawal of the amount lying with its account along with accruals by respondent without issuance of any notice to the petitioner and without any further delay. The respondent to appear before the State Commission for the purpose of withdrawal on 15.12.2012 by taking dasti order and petitioner also may inform the State Commission privately of this order.

 

          As agreed between the parties, the house shall be immediately delivered to the petitioner within one week after the withdrawal of the amount. In case the respondent will not appear before the State Commission on 15.12.2012 for the purpose of withdrawal, the petitioner shall be delivered the possession of the said house in question by end of December, 2011. Thereafter, the petitioner will be entitled to withdraw the amount deposited with State Commission, without any notice to the respondent and may directly remit the same to the respondent by a DD.  In case the process for withdrawal of the money by petitioner on account is delayed on account of technical reasons, he shall give undertaking that the amount so withdrawan will be immediately paid to the respondent as soon as it will be refunded along with accruals. The withdrawal is in respect of amount deposited in FA No.303 of 2007 in terms of above order, which is consented to by the parties. The revision petition is disposed of with liberty to the petitioner to execute the consent order.
