F I N A L    O R D E R
1. The complainant purchased a Motor bike on 31.08.2020 and obtained Temporary Registration vide No- TR 01 BC Tem 3665 dated 18.01.2021. 0n 13.02.2021 the said vehicle met with an accident which was intimated to the O.P. Insurance company and lodged own damage claim which was rejected by the O.P. Insurance co. on 16.03.2022 on the ground that the temporary registration is/was valid for one month only. Hence, there has been violation of policy of Insurance.
2. From the policy of Insurance it appeared that the policy period was 31.08.2020 to 30.08.2021 covering the date of alleged accident on 13.02.2021. The complainant has submitted certified copy of the Temporary Registration and certified copy of FIR as per order dated 28.03.2024. Since the Temporary Registration shows that it covers the date of accident we are inclined to allow the claim of the complainant.
3. The case is decided accordingly in favour of the complainant.
4. In the result, it is ordered that the O.P. Insurance Company shall pay the repairing cost of Rs.42,000/- with interest @ 7.5% P.A. from the date of raising claim on 16.03.2022 till the date of actual payment. The O.P. shall also pay compensation of Rs.5,000/- for deficiency in service.
5. The case stands disposed off.
6. Supply copy of this Final order free of cost to the parties.
